General Terms and Conditions SwissEver Hotel Zug
For seminars, events, groups and hotel rooms
General
1. Subject matter of the contract
These General Terms and Conditions govern the legal relationship between the guest and the SwissEver Hotel Zug (Canonica Hotel Management Cham SA)(in this case "the hotel"), unless otherwise agreed. The reservation/order confirmation or the offer signed by you for confirmation serves as the basis.
2. Scope of application
These General Terms and Conditions (hereinafter referred to as GTC) apply to the provision of rooms and/or conference and banquet facilities as well as to all other associated services and deliveries of SwissEver Hotel Zug, Canonica Hotel Management Cham SA (hereinafter referred to as SwissEver Hotel) to customers. All offers made by SwissEver Hotel are based on the following GTC. They form an integral part of every contract. Should the present GTC contradict any contractual conditions of a customer, the present GTC shall take precedence.
3. Option data
Option dates (offers, order confirmations, etc.) are binding for both parties. SwissEver Hotel Zug (Canonica Hotel Management Cham SA) may automatically dispose of the reserved premises/rooms after expiry of the option period.
4. Conclusion of contract
Following the reservation by the Client, the Client shall receive a written reservation confirmation from SwissEver Hotel. The contract between the parties shall only be concluded with this written reservation confirmation from SwissEver Hotel to the Client.
5. Services, payments and prices
SwissEver Hotel undertakes to provide the services ordered by the customer and promised in writing by SwissEver Hotel.
All prices are in Swiss francs (CHF) and include the statutory value added tax (VAT).
The SwissEver Hotel is entitled to demand an appropriate deposit at any time. The amount of the deposit and the payment dates shall be agreed in writing in the contract. If the customer does not fulfil his obligation to make the down payment in due time, SwissEver Hotel shall be entitled to withdraw from the contract after setting a reasonable grace period. The customer shall be liable to SwissEver Hotel for any resulting damage.
If no down payment is requested by SwissEver Hotel, the entire invoice amount shall be paid by the Client by credit card (Mastercard, VISA, American Express, Diners, JCB), debit card (EC/Maestro, Postcard) or in cash at the latest at the time of departure. If payment by invoice is agreed, the total invoice amount is due 10 days after the invoice date. In the event of late payment, SwissEver Hotel is entitled to charge interest on arrears at a rate of 5%.
SwissEver Hotel expressly reserves the right to change prices.
6. Liability
The customer is liable to the SwissEver Hotel for all damage and loss or other damage caused by him/herself, his/her employees, his/her agents or event participants or other third parties. SwissEver Hotel declines all liability for theft of and damage to items brought in by the customer from event participants or third parties. The insurance of exhibits and other items brought in by the customer, event participants or third parties is the responsibility of the customer. SwissEver Hotel may demand proof of sufficient insurance from the Client at any time.
The Client is obliged to maintain peace and order. He/she undertakes to indemnify SwissEver Hotel in full against all civil and public law claims brought against SwissEver Hotel by authorities or third parties (including event participants, guests or employees and contractual partners of the Client) on the basis of his/her event or to pay for all corresponding claims.
The SwissEver Hotel shall only be liable for intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, in particular for slight or medium negligence or for indirect damage, in particular loss of profit, is excluded.
7. Withdrawal of the SwissEver Hotel
If the performance to be rendered by SwissEver Hotel under the contract is made substantially more difficult or impossible in whole or in part by force majeure or other circumstances not caused by SwissEver Hotel, SwissEver Hotel may withdraw in whole or in part without compensation to the extent of the part of the contract not yet fulfilled.
The SwissEver Hotel is also entitled to withdraw without compensation if there is reasonable cause to believe that the events may jeopardise the smooth running of the business, the safety or the reputation of the SwissEver Hotel in the public or if the customer breaches clause 13 of these GTC. SwissEver Hotel expressly reserves the right to assert any claims for damages against the customer.
Hotel rooms
8. Arrival and departure
The hotel rooms shall be ready for occupancy from 3.00 p.m. on the day of arrival and shall be vacated by 11.00 hrs at the latest on the day of departure.
9. Block bookings / room allotments
No later than 14 days prior to arrival, the SwissEver Hotel shall receive from the Client a list of participants with the following details: First and last names of all guests, time of arrival, payment conditions of the guests.
After the deadline set by SwissEver Hotel, the rooms still available in the respective contingent will be released for open sale.
10. Cancellation conditions
The following cancellation conditions apply both to cancellations of bookings and no-shows as well as in the event of early departure.
Cancellations of bookings of individual hotel rooms (up to 3 rooms) must reach the SwissEver Hotel no later than 15:00 local time on the day before the date of arrival. In case of cancellation after this deadline, the room rate for the first night will be charged.
Cancellation of a block booking of several hotel rooms (4 rooms or more) must reach the SwissEver Hotel as follows at the latest:
Up to 10 rooms: 14 days before arrival
Up to 25 rooms: 30 days before arrival
From 26 rooms: 42 days before arrival
In the event of cancellation after the above deadlines, the customer will be charged cancellation costs as follows:
Up to 10 rooms:
7-13 days prior to arrival: 75% of the total amount of the contracted services.
6 or less days before arrival: 100% of the total amount of the contracted services
Up to 25 rooms:
11-29 days before arrival: 75% of the total amount of the contracted services
10 or less days before arrival: 100% of the total amount of the contracted services
From 26 rooms:
21-41 days before arrival: 75% of the total amount of the contracted services
20 or fewer days prior to arrival: 100% of the total amount of the contractually agreed services.
For all cancellations, services provided in advance by the SwissEver Hotel and its partners must be paid in full in all cases.
The hotel reserves the right to stipulate individual cancellation conditions in the contract.
Events and seminars
11. Use of rooms and authorisation
The SwissEver Hotel reserves the right to make room changes, provided that the rooms meet the requirements and interests of the Organiser and are reasonable for the Organiser. Any subletting or re-letting of rooms or areas by the Client shall require the prior written consent of SwissEver Hotel.
Unless otherwise stipulated in the contract, the Organiser shall obtain any necessary permits himself and at his own expense. Copyright compensation in connection with music performances shall be registered and paid by the Organiser himself.
12. Number of participants
The Organiser shall inform the SwissEver Hotel of the definitive number of participants (guaranteed number) at least 3 working days before the event. If the actual number of participants is subsequently lower, the guaranteed number stated shall be used as the basis for invoicing; if the actual number of participants is higher, the actual costs incurred shall be invoiced. If the actual number of participants is higher, the SwissEver Hotel does not guarantee that all guests will be accommodated.
13. Fire regulations, safety regulations, installation of decorative material
The Organiser undertakes to comply with the fire regulations of the SwissEver Hotel, in particular to keep escape routes clear, to observe the ban on smoking, etc. The Organiser shall not be liable for any damage caused by fire. Decorative material brought in by the Organiser must also comply with the fire regulations.
The organiser is also responsible for ensuring that no more persons are admitted than the capacity of the room in question. The maximum numbers specified by SwissEver Hotel shall be binding. In the event of any infringement, the SwissEver Hotel declines all liability.
The attachment of decorative materials and other objects to walls, doors and ceilings always requires the prior consent of the SwissEver Hotel. The Organiser shall be liable for any damage incurred by SwissEver Hotel as a result.
14. Cancellation of the event by the organiser
The Organiser must notify the SwissEver Hotel in good time and in writing of any cancellation of a reservation of event premises.
Cancellation deadlines calculated before the event or seminar
Up to 30 participants:
Up to 31 days cancellation free of charge
Cancellation 21-30 days in advance: 50% of the contractually agreed services
Cancellation 11-20 days in advance: 75% of the contractually agreed services
Cancellation 0-10 days in advance: 100% of the contractually agreed services
From 31 participants:
up to 42 days free cancellation
21-41 days 50% of the contractually agreed services
11-20 days 75% of the contractually agreed services
10 days or less 100% of the contractually agreed services
Services provided in advance by the SwissEver Hotel must be paid for in any case.
The hotel reserves the right to stipulate individual cancellation conditions in the contract.
15. Printed matter, media advertisements
The use of logos or images of the SwissEver Hotel in any form by the Organiser shall always require the prior written consent of the SwissEver Hotel. If publication takes place without corresponding consent, SwissEver Hotel shall be entitled to withdraw from the contract. The Organiser shall be liable to SwissEver Hotel for any resulting damage.
16. Catering
Unless otherwise agreed in writing, the Organiser shall be obliged to obtain all food and beverages from the SwissEver Hotel. Otherwise, a tap fee agreed in advance shall be charged.
17.Surcharges
From 0.00 hrs onwards, the following night surcharge shall be charged:
1-50 persons from 51 persons
Until 01.00 CHF 250 CHF 300
Until 02.00 CHF 600 CHF 750
Until 03.00 CHF 900 CHF 1200
18. Payment modalities
The SwissEver Hotel Zug (Canonica Hotel Management Cham SA) reserves the right to demand full or partial advance payment for reservations. For events with a foreign billing address, we ask the guest to provide their credit card number with expiry date as a guarantee and/or 100% prepayment. This also applies to events booked from within Switzerland.
Unless otherwise agreed, the hotel will invoice the expenses incurred after the event. The organiser may settle the invoice on site or within 10 days of the invoice date. Invoices for events with a turnover of less than CHF 300 are to be paid by the organiser directly on site, otherwise a handling fee of CHF 20 will be charged.
Further provisions
19. Damages
The guest is liable to SwissEver Hotel Zug (Canonica Hotel Management Cham SA) for damages and losses caused by him or his assistants, participants or pets, without SwissEver Hotel Zug (Canonica Hotel Management Cham SA) having to prove fault. The SwissEver Hotel Zug (Canonica Hotel Management Cham SA) declines all liability in the event of theft of or damage to materials brought in by the organiser, participants, speakers or third parties.
20. Applicable law / place of jurisdiction
The contract shall be governed exclusively by Swiss law. The place of jurisdiction shall be the Cantonal Court of Zug in Zug. Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. In such a case, the legally ineffective provision shall be replaced by a provision that is similar in spirit but effective.
